The Demise of the 28-Clause Ceasefire Plan for Ukraine: Why Diplomatic Efforts Continue to Falter

Europe felt a moment of respite on Monday, as the diplomatic emergency triggered by the introduction of a new comprehensive peace framework for achieving ceasefire appeared – briefly – to have been stabilised. A Washington representative spoke of "notable headway" after diplomatic discussions in Geneva. On Monday night, Moscow made its countermove: another massive barrage of aerial bombardment on Kyiv.

The Cycle of Negotiation and Warfare

The succession of contrasting events captured the grim essence of the outgoing year. By day, political struggles are waged: positive announcements are released from different nations. Significant resources is expended on containing particular approaches. By night, Russian leadership forcefully demonstrates the world that, for them, military action persists as the main instrument for achieving "resolution".

Nighttime Reality

As military strikes unfolded into the early hours of Tuesday, the immediate reality of Ukraine's defenselessness was exposed. Ukraine is capable of detecting rocket firings from Russian territory, a capability enabled by up-to-date information. From observation points, defense planes that had been scrambled to intercept incoming cruise missiles streaked across the sky – sophisticated military planes supplied to Ukraine by European allies.

Soon thereafter, Kyiv's missile defense engaged: several firings deployed against a Russian ballistic missile. This was a sophisticated defense system at work, most likely supplied through allied countries. Every launch creates sudden vibrations, shaking the windows. The brief panic quickly transforms into resigned acknowledgment: perhaps the hostile projectile won't strike its target this time, sparing the city from ruin and further power outages.

Persistent Threats

Soon after, a large-caliber weapon engaged a aerial vehicle in the vicinity, part of a rapid response unit – probably imported technology. Regrettably, the shots failed to hit the opposing UAV – it continued its flight toward its target.

With pauses, this continued until dawn. Kyiv awoke to the daybreak reports: multiple fatalities, destruction and heating outages in many homes as a result of the night's assault. As typically, everyone still went about their day – experiencing conflict. But those 24 hours demonstrated Ukraine's vital need on Western support – a dependence that European nations are demonstrably unable to replace in the near term.

Ineffective Peace Efforts

The comprehensive proposal from US administration generated strong feelings, controversy and deep concern – and briefly redirected concern from Ukraine's most significant graft case in years. Yet, we have seen this script before, after previous diplomatic encounters and bilateral conferences.

Every new approach from US leadership follows the consistent cycle: a political offensive against Ukraine, which Kyiv, with allied governments, manages to fend off. They manage the tension but never actually win the battle. This cycle will, no doubt, continue.

Political Considerations

It is tempting to accuse specific actors of repeatedly advocating Russian terms. But that does not seem to be the complete picture. Washington works based on a premise understood by international relations experts: you cannot secure via talks what you have failed to defend militarily. The American government believes that it is unrealistic to force Russia to surrender the areas that it presently holds in Ukraine's south or east.

The problem is that while accepting these circumstances, US leadership does minimal to discourage Russia, through diplomacy or military means, from believing that the status quo will not change more in its benefit in the coming year.

Conflicting Perspectives

Therefore, the Kremlin is confident that the clock favors them – that Ukraine and its allies are nearing depletion. Their incentive to agree to terms that does not give them the greatest potential benefit is almost completely absent. There may be many attempts to achieve ceasefire, but they will persist as long as Russia's leadership remains completely certain in the outcome.

On the contrary, Ukraine's government believes that Ukraine can still endure, gradually sacrificing lives and land but preventing a entire defensive failure until situations evolve in its benefit.

Present Conditions

Realistically, there are no real preconditions for a ceasefire. Now, subjective factors are coming into play: personal goals to negotiate peace and achieve global acclaim, and Ukrainian leadership's double obstacles – on one hand, not to estrange crucial supporters, and on the other, to unite the population around the country's interests against any initiative Kyiv finds unacceptable, so that their priority does not shift toward internal issues. And although their task will now be much harder after latest incidents, it remains highly unlikely that this will alter their fundamental strategy.

These two forces are driving the talks.

Assessment and Future

It took a only one week to eliminate the proposed articles of the most recent proposal. Forceful and unpredictable management of the matter by American leadership, resistance by Ukraine and the other European countries, along with pacifying measures of negotiators, and finally, recent disclosures, all served their function.

While new plans based on previous concepts are approaching, Kyiv, London and other European capitals should arrive at a critical understanding: Ukraine and Europe will only be able to resist diplomatic offensives from Washington that are rooted in Kremlin requirements and reflect specific hesitation to alter the situation, if they remain united and improve their protective measures at a considerably quicker tempo. If they do, neither political nor armed coercion will be able to overcome them. In the meantime, Ukraine's ability to repel nightly air assaults will, for the coming months, primarily depend on continued Western support.
